Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SKAFLD platform (the "Service"), operated by SKAFLD ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

1.1 Age Requirements

To create a parent or guardian account, you must be at least 18 years of age. Child accounts may only be created by a parent or legal guardian. By creating a child account, you represent that you are the parent or legal guardian of the child and have authority to consent on their behalf.

1.2 Family Helper Accounts

Family helper/admin accounts (for grandparents, babysitters, and other trusted individuals) may be created by parents. The parent who creates a helper account is responsible for the helper's use of the Service and for setting appropriate permissions.

2. Account Registration and Security

2.1 Account Information

You agree to provide accurate information when creating your account and to keep your account information current. You are responsible for maintaining the confidentiality of your password and PIN, and for all activity that occurs under your account.

2.2 Child Account Security

Parents are responsible for the security of child accounts, including the child's PIN. Parents should choose age-appropriate PINs and understand that children's activity within the Service is visible to all parents and approved helpers in the family.

2.3 Unauthorized Access

You agree to notify us immediately through our website at skafld.io if you become aware of any unauthorized access to or use of your account.

3. The Service

3.1 Description

SKAFLD is a family connection platform that helps families organize household responsibilities through quests, track behavioral progress, facilitate family meetings, and encourage positive habits through gamification. The Service is designed for families with children ages 4-14.

3.2 Beta Access

The Service is currently in a beta period. During beta, access is by invitation only. Beta users acknowledge that:

• The Service may contain bugs, errors, or incomplete features
• Features may be added, modified, or removed without notice
• Service availability is not guaranteed during beta
• Data created during beta will be preserved when the Service launches generally, barring unforeseen technical circumstances

3.3 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or security reasons. We will endeavor to provide advance notice of planned downtime when possible.

4. Subscriptions and Payment

4.1 Plans

SKAFLD offers subscription plans as described on our pricing page. Plans are billed per family (not per child) on a monthly or annual basis. Plan features and pricing are subject to change with 30 days' notice to active subscribers.

4.2 Free Trial

New subscribers receive a 14-day free trial with full access to all features. You may cancel at any time during the trial period without charge. If you do not cancel before the trial ends, your selected plan will automatically begin and you will be charged.

4.3 Billing

When payment processing is active, billing will be handled by Stripe, a PCI-compliant payment processor. We do not store credit card numbers on our servers. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.4 Cancellation and Refunds

• You may cancel your subscription at any time through account settings or by contacting support@skafld.io
• Cancellation takes effect at the end of the current billing period — you retain access until then
• Annual subscriptions may be eligible for a prorated refund within the first 30 days if you are unsatisfied
• Monthly subscriptions are non-refundable for the current billing period

4.5 Plan Downgrades

If you downgrade from the Family plan to the Standard plan and have more than 2 active children, you will need to deactivate child accounts to meet the Standard plan limit before the downgrade takes effect. No child data is deleted during a downgrade — deactivated accounts can be reactivated upon upgrading.

5. Acceptable Use

5.1 You Agree Not To:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Create accounts for children who are not your own or for whom you do not have legal guardianship
• Attempt to access another family's data or impersonate another user
• Upload harmful content, including malware, offensive images, or content that exploits minors
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use automated means (bots, scrapers) to access the Service
• Interfere with or disrupt the Service's infrastructure
• Share your family code with individuals you do not trust to access your family's data

5.2 Content Standards

Chore descriptions, reward names, good deed descriptions, strike reasons, mood notes, and other user-generated text must not contain content that is obscene, threatening, harassing, defamatory, or otherwise objectionable. We reserve the right to remove content that violates these standards.

5.3 Photo Uploads

Children may upload photos as proof of chore completion. Parents are responsible for reviewing uploaded photos. Photos must not contain inappropriate content. We reserve the right to remove photos that violate our content standards.

6. Intellectual Property

6.1 Our Property

The Service, including its design, code, features, graphics, logos, and documentation, is owned by SKAFLD and is protected by copyright, trademark, and other intellectual property laws. The SKAFLD name, logo, and brand elements are trademarks of SKAFLD.

6.2 Your Content

You retain ownership of all content you create within the Service (chore descriptions, reward names, meeting notes, photos, scene creations, etc.). By using the Service, you grant us a limited, non-exclusive license to store, display, and process your content solely for the purpose of providing the Service to you and your family.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, we may use them without obligation or compensation to you.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your family's information, including your children's information. The Privacy Policy is incorporated into these Terms by reference.

8. Disclaimers

8.1 No Professional Advice

SKAFLD is a family organization and connection tool. It is not a substitute for professional parenting advice, psychological counseling, medical guidance, or educational services. The behavioral mechanics (strikes, good deeds, mood tracking) are designed to support family communication, not to diagnose or treat any condition.

8.2 "As Is" Provision

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKAFLD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

10. Indemnification

You agree to indemnify and hold harmless SKAFLD, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

11.1 By You

You may stop using the Service and delete your account at any time. Upon deletion, all your family data will be permanently removed as described in our Privacy Policy.

11.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will make reasonable efforts to notify you before termination, except where immediate action is required to protect the Service or other users.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 9, 10, and 13 survive termination.

12. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will notify you through the application or via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service and delete your account.

13. General Provisions

13.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from these Terms or the Service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. Small claims court actions are exempt from this arbitration requirement.

13.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.4 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SKAFLD regarding the Service.

13.5 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
